Terms & Conditions

Howe Software LLC · Last updated: September 22, 2026

These Terms & Conditions ("Terms") are a legal agreement between you and Howe Software LLC, a limited liability company organized in the State of Illinois, United States ("Howe Software", "we", "us", or "our"), governing your access to and use of the Hot Tub / Pool Service Manager software service, including its website, mobile and web applications, and related support (together, the "Service").

By creating an account, subscribing to the Service, or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Hot Tub / Pool Service Manager is a business software product for hot tub, spa, and pool service companies. Depending on your subscription, it lets you manage customer records, technician assignments and schedules, routes, service records and photos, customer-facing recap and payment pages, invoices, business expenses, and service catalogs.

The public demonstration areas of the Service contain fictional example data for a fictional company ("Premier"). Demonstration data does not represent any real customer, technician, or company.

2. Accounts and eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. If you sign up on behalf of a company, you represent that you have authority to bind that company to these Terms.

You are responsible for keeping your login credentials confidential, for all activity that occurs under your account, and for providing accurate account information and keeping it up to date. Each subscription is for one service company; you may not share your account with another company.

3. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for any unlawful purpose or in violation of any applicable law;
  • engage in fraud, spam, or deceptive practices;
  • infringe the intellectual property or privacy rights of others;
  • interfere with the security or operation of the Service, including by introducing malware, probing or scanning for vulnerabilities, attempting to gain unauthorized access, scraping, or harvesting data from the Service;
  • access or use another company's data without authorization; or
  • resell, sublicense, or redistribute access to the Service without our written consent.

4. Your content

You remain the owner of the content you enter into the Service, including customer records, schedules, service notes, photos, and invoices ("Your Content"). You grant us a limited license to host, store, and process Your Content solely as needed to provide and support the Service for you.

You are responsible for Your Content and for having the right to collect and share it. If your customers' personal information is entered into the Service, you are responsible for complying with the privacy laws that apply to your business, and for obtaining any consents needed to send them messages or links generated by the Service.

5. Intellectual property

The Service, including its software, design, documentation, and branding, is owned by Howe Software LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan during your subscription. You may not reverse engineer the Service, circumvent technical limits, or use it to build a competing product.

6. Fees, subscriptions, and payment

The Service is offered as a paid monthly subscription, currently $29.99 per month, and may include a one-time setup fee. Applicable taxes are handled at checkout. We may change pricing for future billing periods with reasonable notice before the change takes effect.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. You can cancel your subscription at any time; cancellation stops future billing.

Homeowner payments initiated through customer payment links are processed by the payment provider shown on the checkout page and are between you and your customer; we provide the software that creates and shares those links and records their status.

7. Service availability

We work to keep the Service available and reliable, but we do not guarantee that the Service will be uninterrupted, timely, or error-free. We may modify, suspend, or discontinue parts of the Service; if we discontinue the Service entirely for paying subscribers, we will provide reasonable notice and an opportunity to export your data.

8. Suspension and termination

You may stop using the Service and cancel your subscription at any time.

We may suspend or terminate your access to the Service if:

  • you materially breach these Terms;
  • subscription fees go unpaid;
  • your account or use of the Service creates a security or fraud risk; or
  • you repeatedly or seriously violate our policies.

When your account is closed or terminated, your ability to access your data ends. We will make your business data available for export for a reasonable period (at least 30 days, unless prohibited by law or required for a security investigation) before deleting or anonymizing it.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. The Service organizes the information you and your team enter; we are not responsible for the accuracy of service records, chemical readings, recommendations, or business decisions made using the Service.

10. Limitation of liability

To the fullest extent permitted by law, Howe Software LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising from or related to your use of the Service. Our total aggregate liability for all claims is limited to the subscription fees you paid to us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, death, or personal injury caused by negligence.

11. Indemnity

You agree to indemnify and hold harmless Howe Software LLC from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service in violation of law, or your breach of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and update the date above. Continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law rules. The state and federal courts located in Illinois have exclusive jurisdiction over disputes arising from these Terms or the Service.

14. Other terms

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. You may not assign your account to another party without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures to perform caused by events beyond our reasonable control (force majeure). These Terms are the entire agreement between you and Howe Software LLC regarding the Service.
